Terms of Service

1. Acceptance of terms

By accessing or using the Taackk platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms form a legally binding agreement between you and Taackk Pty Ltd (ABN 83 701 856 671) ("Taackk", "we", "us", or "our").

2. Description of service

Taackk is a marketplace that connects businesses with fractional executives and senior leaders. We provide tools for profile creation, matching, communication, and engagement management. We are a platform intermediary — we do not employ the leaders listed on the Platform, and we are not a party to any engagement agreement between a business and a leader.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use the Platform. By registering, you represent that you meet these requirements. Organisations using the Platform warrant that the individual registering has authority to bind the organisation to these Terms.

4. Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable use

You agree not to:

• Provide false, misleading, or fraudulent information in your profile or communications.
• Use the Platform to harass, abuse, or harm other users.
• Attempt to circumvent our matching or subscription systems.
• Scrape, reverse-engineer, or otherwise extract data from the Platform without authorisation.
• Use the Platform for any unlawful purpose or in violation of applicable laws.
• Introduce malware, viruses, or other harmful code.
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure.

6. Leader applications and approval

Leaders must apply and be approved by Taackk before their profiles are published. Approval is at our sole discretion. We reserve the right to revoke approval at any time if a leader violates these Terms or if their profile information is found to be inaccurate.

7. Fees and payments

Subscription fees are charged in advance and are non-refundable except as required by law. All payments are processed by Stripe. By providing payment information, you authorise us to charge the applicable fees. We reserve the right to change our pricing with 30 days' notice to existing subscribers.

8. Intellectual property

The Platform, including its design, code, and content created by Taackk, is owned by Taackk and protected by intellectual property laws. You retain ownership of content you submit to the Platform (your profile, messages, etc.) and grant Taackk a limited licence to display and use that content to operate the Platform.

9. Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers and limitation of liability

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Taackk is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability to you for any claim shall not exceed the fees you paid to us in the 12 months preceding the claim.

11. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use the Platform ceases and we will handle your data in accordance with our Privacy Policy.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email or via a notice on the Platform at least 14 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance.
